·         "APPLI" (counterfeit of "APPLE")

·         "SONYX" (counterfeit of "SONY")

·         "ABIBAS" (counterfeit of ADIDAS)

·         "ARMONI" (counterfeit of ARMANI)

·         Any other brand that is intentionally misrepresented in a counterfeit manner.

2.     Prohibition of Unauthorized Brands:

·         Sellers are also prohibited from selling products from other manufacturers using their trademarks and brands without explicit permission from the respective manufacturers. We value intellectual property rights and require sellers to respect those rights when listing products on our platform.

3.     Documentation for Branded Items:

To list branded items on our platform, sellers must provide valid documentation to demonstrate one of the following:

They are authorized dealers of the brand they intend to sell.

·         The brand they intend to sell is their own, and they possess official licensing for it.

4.     Brand Approval and Document Submission:

A dedicated section within your seller dashboard will be provided for requesting approval to list specific brands and submitting the necessary documents. This ensures a streamlined process for sellers comply with our policies.

5.     Policy Enforcement:

·         Cool Orca Marketplace takes policy compliance seriously. In the event of non-compliance with the rules and requirements outlined in this policy, the marketplace reserves the right to take appropriate actions, including, but not limited to, store suspension and the imposition of fines.

·         For more detailed information on specific aspects of selling branded goods and trademark usage, we encourage sellers to review our "Regulations for Branded Goods" and "Trademark Guidelines."                           

·         Policy Enforcement:

·         Cool Orca Marketplace takes policy compliance seriously. If we notice that a seller is breaking these rules and selling fake or unauthorized brands, the following actions will be taken:

·         Imposition of Fine: We reserve the right to impose a fine on the store and the seller found in violation of this policy. The amount of the fine will be determined at our discretion.

·         Store Blocking: In cases of repeated violations or severe breaches of this policy, we may choose to block the seller's store without the possibility of restoration. This action will be taken to protect the integrity of our trademarks and brands.

·         Branding Guidelines:

·         CoolOrca and SpyOrca ("Cool Orca", "Spy Orca", "our Marks") trademarks and brands are CoolOrca.com, Inc. intellectual property and are important and valuable assets of the Corporation. Trademarks must be used properly. These Guidelines apply to the use of the marks we may make available to you as part of Program Content “Cool Orca” and “Spy Orca” Marks. Strict compliance with these Guidelines is required at all times, and any use of our Marks in violation of these Guidelines will automatically terminate any license related to your use of our Marks.
